1. Rule 40(3) of the Tribunal Procedure (Upper Tribunal) Rules 2008 (SI 2008/2698 as amended) applies to this decision.
2. The appeal concerns a Human rights claim. Mr Kandola indicated that having read the judge's decision, rules and skeleton argument of the he was unable to pursue the respondent's grounds before me.
3. By consent the appeal to the Upper Tribunal is dismissed as follows:
(a) the First-tier Tribunal decision is not affected by error of law.
(b) the First-tier Tribunal decision allowing the appeal stands.
