JUDGE H J BYRT, QC: We have taken some time to consider this matter because obviously, it is very important to your client. However, we have looked through the reasons of the Tribunal to see as to where the point of law would be that you refer to and at the end of the day, we have come to the conclusion that it is purely a question of fact. In consequence, we take the view that it would be inappropriate to allow this case to proceed further, and make our order accordingly.
