JUDGE SMITH Q.C.: This is an appeal from decision of an Industrial Tribunal Chairman refusing an extension of time in which to apply for the extended reasons of the Tribunal's decision. The original Tribunal's decision was given in May 1994 and the application for extended reasons was not made until eleven months later and was refused in the terms set out in the Chairman's letter of 13th July 1995 on the grounds that the request had only been made eleven months after the Tribunal's decision with summary reasons, whereas it should have been made within 21 days of the date upon which the Appellant was sent the summary reasons, namely 9th June 1994.
In our judgment this was a proper reason for refusing to extend the time permitted and we must uphold the Chairman's decision to refuse the request to provide extended reasons after such a long delay. Accordingly on that issue the appeal must be dismissed.
