    APPEARANCES

For the Appellants MR P EDWARDS
    (of Counsel)
    The Treasury Solicitor
    Queen Anne's Chambers
    28 Broadway
    London
    SW1H 9JS

JUDGE PETER CLARK: We have considered the Notice of Appeal in this case and the detailed Skeleton Argument prepared by Mr Edwards and supplemented by oral submissions. We have concluded that there are arguable points to go forward to a full hearing

in relation to the Industrial Tribunal's decision that it is just and equitable to allow complaints by the Respondent, Mrs Plant, of verbal and physical harassment at Brixton Prison between October 1987 and July 1988 to proceed, notwithstanding that those complaints are some nine years out of time.

We shall direct that the case be listed for a full hearing, estimated to take half a day; Category C. There will be exchange of Skeleton Arguments between the parties, not less than 14 days before the date fixed for the full appeal hearing, copies of those Skeleton Arguments to be lodged at the same time with this Tribunal.

At this stage there will be no direction for Chairman's Notes of Evidence, but liberty is given to both parties to apply, should an issue arise as to what was said below.
