    MR JUSTICE LINDSAY: We have before us an application and we have had a very recent message that confirms to us that Mr Carl Joseph, the prospective appellant, is currently in custody serving a term of imprisonment at H M Prison Bristol. We feel that Mr Joseph is entitled to appear at a preliminary hearing and although there is has been no formal application for an adjournment on account of his imprisonment, we are not minded to deal with the matter today, but simply to adjourn it for a suitable date to be fixed.

    Mr Joseph is to be told that if he wishes to attend, then arrangements will have to be made to fix a day that is convenient to the Prison Service as well as to the EAT, but that if he is content that the matter should go forward without his being present, well then, of course a date can be fixed that does not require the co-operation of the Prison Service or indeed of anyone else other than the listing office of the EAT. On that basis, we simply adjourn this matter generally to be restored one way or another as we have indicated.
