JUDGE H WILSON: We are unanimous that the matter should go forward for full argument and we identify the matters for argument as first, whether the Chairman erred in failing to draw the relevant distinction between the position over the power to change a term in a contract of employment and the comparable position and power to change a term in the pension scheme. Secondly whether Chairman erred in law in holding that the notice given by the employer was effective to vary, not only the pension scheme but also the relevant term in the Appellants contract of employment, also unilaterally that is what it comes to.
The matter is to be listed for 2 hours category C.
