Decision notes | [2019] UKFTT 109 (PC). Mr and Mrs Goepel transferred an area of land for no consideration to Mr Shelley, one of their neighbours. Later Mrs Goepel (only) objected to the registration of the transfer for a number of reasons, principally that she and her husband had not known what they were signing and/or that there was a misrepresentation by silence about the absence of consideration. It became clear from Mr Goepel’s evidence at the hearing that he had known perfectly well what he was signing; I found on the balance of probabilities that Mrs Goepel knew too, and that there had been no misrepresentation. |
