Decision notes[2019] UKFTT 725 (PC). Relative priorities of two transfers of land - whether the transferee under the first transfer (the applicant) had been in actual occupation of the land which was the subject of the second transfer at the time when the second transfer was made. The applicant relied upon the occupation of the land by her tenants. HELD: that on the facts, the applicant-™s tenants had not been in actual occupation at the time of the second transfer, and that even if they had been, that could not be equated with actual occupation by the applicant
