Summary: The complainant requested any information held by the council on the disposal or sale of a piece of land to the Fire Service. The council withheld the information on the basis that section 43 applied (commercial interests exemption). The Commissioner's decision is that the information should be disclosed as there would be no prejudice to disclose it at this time. The Commissioner also decided that even if prejudice was likely the public interest in disclosing the information outweighed that of maintaining the exemption in this instance, and therefore the council to disclose the requested information to the complainant within 30 days.
