Summary: The complainant requested information, in relation to a number of geographical areas, regarding the percentage of premises without a TV licence, the number of premises with a TV licence and the number of prosecution statements taken. The BBC refused to disclose this information relying on section 31(1) (a) -˜law enforcement-™ to withhold the information. The Commissioner has investigated and found that section 31(1) (a) is not engaged in relation to the number of premises with a TV licence and the number of prosecution statements taken. However, he found that section 31(1) (a) is engaged in relation to the percentage of premises without a TV licence and that the public interest in maintaining this exemption outweighed the public interest in disclosure of the information. The Commissioner also found that the BBC breached the requirements of sections 17(1), 1(1) (a) and 16(1) in its handling of the request. He requires the BBC to disclose to the complainant the number of premises with a TV licence in the areas specified in the request; and the number of prosecution statements taken in the areas specified in the request.
