BBC (Decision Notice) [2009] UKICO FS50201449 (04 November 2009)

Summary: The complainant made a request for information relating to an incident in 2005 where Lord Foulkes and Lord Maxon lobbied the then Director General of the BBC, Mark Thompson, to have Iain Macwhirter removed from presenting BBC programmes. The BBC argued that this information was held for the purposes of art, journalism or literature and was therefore derogated and fell outside the scope of the Act. The Commissioner upholds the BBC-™s position and does not require them to take any further action.
