Summary: The complainant made a request for details of the royalty payments made to the estate of the composer of -Sailing By- on Radio 4. The BBC argued that this information was held for the purposes of art, journalism or literature and was therefore derogated and fell outside the scope of the Act. The Commissioner upholds the BBC-s position and does not require them to take any further action.
