Summary: The complainant made a request for information relating to BBC radio-s regional programme production for each of the last three years in terms of the number of hours broadcast; the number of hours of originations; the number of hours defined as -eligible- for independent supply review; the overall budgets for BBC Radio networks; total production budgets for the networks; the cost and number of hours of programmes bought from independent suppliers. The BBC responded by stating that the information was held for the purposes of art, journalism or literature and was therefore derogated. The Commissioner-s decision is that the BBC correctly determined that the information is held to a significant extent for these purposes and therefore the BBC is not obliged to comply with Parts I to V of the Act.
