Summary: On 10 November 2008 the complainant requested that Milton Keynes Council (the -˜council-™) should make all the documentation it held which related to Petsoe Wind Farm available for inspection. The council-™s response to the request was piecemeal and protracted. Initially, some information was provided and some refused under section 21 and section 22 of the Freedom of Information Act 2000 and the complainant was invited to inspect the council-™s planning files. However, the complainant argued that the council was deliberately withholding information. After the Commissioner-™s intervention, the council agreed to consider the request under the Environmental Information Regulations 2004 (the -˜EIR-™). It provided further information and after some negotiation, it was agreed that the complainant would be satisfied with specific emails from the accounts of individuals which the council should have provided at the time the request was made. The Commissioner is satisfied that the council has provided those requested emails which it now holds. However, the Commissioner finds that the council breached regulation 5(1), 5(2), 11(3)(a) and (b), 11(4) of the EIR.
