Summary: The complainant requested information relating to legal advice obtained by the Assembly Government in relation to two planning appeals. The Assembly Government refused to disclose the information by virtue of section 42 of the Act and regulations 12(4)(e) and 12(5)(b) of the EIR. The Commissioner has investigated and determined that the request should have been handled solely under the provisions of EIR. The Commissioner has found that regulation 12(5)(b) was engaged and the public interest favoured maintaining the exception. Therefore he has decided that the Assembly Government was correct to withhold the information in question and he requires no steps to be taken.
