Summary: In September 2007, the complainant requested a copy of the 2006 report of the Office of the Surveillance Commissioner-™s (OSC) Inspection Report relating to the BBC. The complainant also requested a copy of the OSC-™s covering letter and the BBC response to the report. The public authority provided the complainant with the information requested but withheld some of the information under the provisions of section 31 (the Law enforcement exemption), section 40 (personal data) and section 42 (legal professional privilege) of the Freedom of Information Act 2000 (the Act). The Commissioner found that the public authority correctly applied sections 31(1) (a) and 42(1) to the withheld information, however the Commissioner found that the BBC had breached section 10(1) of the Act in responding to the complainant-™s request outside the statutory time limit.
