Lancashire County Council (Decision Notice) [2010] UKICO FS50250070 (06 September 2010)

Summary: The complainant requested information about confidentiality policies, information concerning data subjects-™ providing consent and anything else the public authority thought suitable. The public authority applied section 14(1) to the request. It explained that in its view the request was vexatious. It maintained its position in its internal review. The Commissioner has considered this case carefully and has determined that a reasonable public authority could find the request for information vexatious. He therefore upholds the application of section 14(1) and dismisses the complaint. He also found that the public authority has correctly relied on section 17(6). The Commissioner requires no remedial steps to be taken. Information Tribunal appeal number EA/2010/0166 dismissed.
Section of Act/EIR & Finding: FOI 14 - Complaint Not upheld, FOI 17 - Complaint Not upheld
