Summary: The complainant requested a number of pieces of information about a named doctor. The Trust refused to provide this information, withholding some of it under section 31(2) and some of it under section 40(2). During the Commissioner-™s investigation the Trust confirmed that it was relying upon sections 40(2) and 40(3)(a)(i), as well as sections 31(1)(g) and 31(2)(c), (d) and (i). After investigating the case the Commissioner found that these exemptions did not apply to the information, and therefore the withheld information should be disclosed. In addition to this, the Commissioner found that the Trust did not meet the requirements of sections 10 and 17.
