Summary: The complainant requested information from Bradford Metropolitan District Council (Bradford MDC) about planning permission for three plots on a development near his residence. The Information Commissioner-™s decision is that the public authority did not deal with the request for information in accordance with the EIR in that it did not apply the correct legislation when handling the request. He therefore requires Bradford MDC either to provide the information requested in compliance with regulation 5(1) or issue a valid refusal notice that complies with regulation 14 of the EIR.
