BBC (Decision Notice) [2011] UKICO FS50353677 (14 February 2011)

Summary: In response to a BBC news article, the complainant made a request to the BBC for a copy of communications sent to and from Carter-Ruck LLP with regards to the making of a Panorama programme about Scientology. The complainant also requested that the BBC release any other communications sent to or from Carter-Ruck LLP or any other Scientology representative that concerned John Sweeney, Panorama, or Scientology. The BBC responded by stating that the requested information fell outside the scope of the Freedom of Information Act 2000 (the -Act-) because it is information held for the purposes of journalism, art or literature and is therefore derogated. The Commissioner-s decision is that the information is genuinely held for the purposes of journalism. Therefore the Commissioner finds that the BBC was not obliged to comply with Parts I to V of the Act. This decision notice is currently under appeal to the Information Tribunal.
