Summary: The complainant requested a considerable amount of information about the public authority-™s procedures regarding Summary Care Records. The public authority did not originally treat it as a request for information under the Act and tried to respond to the request under normal course of business. The complainant referred the request to the Commissioner who advised the public authority to issue an appropriate response. It did then do so. The complainant subsequently refined his request, but asked for the Commissioner to issue a formal decision notice about the delays that he experienced in obtaining a substantive response from the public authority. The Commissioner finds that the public authority breached the procedural requirements of sections 10(1) and 17(5) in this case. However, he requires no remedial steps to be taken.
