Summary: The complainant requested information from the Department for Regional Development (DRD) on the details of contracts for environmental maintenance in several geographical areas for 2008, including schedule of rates, calculations and scores achieved. DRD disclosed some information but withheld the remainder under section 43(2) of the FOIA. The Information Commissioner-™s decision is that DRD should have handled the request under regulation 12(5)(e) of the Environmental Information Regulations 2004 but that DRD correctly withheld the information. The Information Commissioner does not require the public authority to take any steps to ensure compliance with the legislation. Information Tribunal appeal number EA/2011/0258 dismissed.
