Summary: The complainant requested the number of deaf and/or disabled sports panellists who have appeared on the BBC programme 'Question of Sport-™ and the number of deaf and/or mobility impaired contestants who have appeared on the BBC programme ' COPYCATS'. The BBC explained the information was covered by the derogation and excluded from FOIA. The Commissioner-™s decision is that this information was held by the BBC for the purposes of -˜journalism, art or literature-™ and did not fall inside FOIA. He therefore upholds the BBC-™s position and requires no remedial steps to be taken in this case.
