Birmingham City Council (Decision Notice) [2013] UKICO FER0483175 (16 December 2013)

Summary: The complainant requested information concerning the redevelopment of Birmingham New Street station and Pallasades Shopping Centre. The Commissioner-™s decision is that Birmingham City Council (the Council) was correct to say that information for the first request is held by Network Rail and not by the Council. However, it incorrectly applied regulation 12(4)(a) in its response to the second request as it does hold relevant information. The Council has subsequently amended its position to state that the second request is manifestly unreasonable as per regulation 12(4)(b). The Commissioner-™s decision is that the request is manifestly unreasonable and that the public interest test favours maintaining the exception. No further action is required.
