Summary: The complainant has requested information relating to the employment of a particular academy broker. The Department for Education (DfE) provided some information in response but refused one part of the request under section 36 (prejudice to the effective conduct of public affairs) and another part under sections 40(2) (third party personal data) and 43(2) (commercial interests) of FOIA. The section 36 item has been disposed of during the course of the Commissioner-™s investigation and so it has been left for him to consider the information withheld under sections 40(2) and 43(2). This comprises the payment rate of the academy broker. The Commissioner has decided that the DfE correctly applied section 40(2) of FOIA to this information and therefore the DfE is not required to take any steps as a result of this notice.
