Summary: The complainant has requested information about numbers of disabled presenters on specific BBC broadcasts. The BBC explained the information was covered by the derogation and excluded from the FOIA. The Commissioner-™s decision is that this information was held by the BBC genuinely for the purposes of -˜journalism, art or literature-™ and did not fall inside the FOIA. He therefore upholds the BBC-™s position and requires no remedial steps to be taken in this case. This decision notice is currently under appeal to the Information Tribunal.
