Summary: The complainant requested copies of correspondence between the public authority and Arts Council England in relation to a funding settlement for Arts Council England following the 2010 spending review for Government Departments. The Commissioner-™s decision is that: the public authority was not entitled to withhold the disputed information on the basis of section 36(2)(b)(ii) FOIA; the public authority was not entitled to withhold the names redacted from copies of the correspondence already provided to the complainant without explaining its basis for doing so under the terms of the FOIA; the letter mentioned in Dame Liz Forgan-™s letter of 21 October 2010 to Rt Hon Jeremy Hunt MP is within the scope of the request.
