Summary: The complainant submitted a set of requests to Malvern Hills District Council (the Council) about its refuse and recycling policy. The Council refused to respond to these requests on the basis of section 14(1) of FOIA because it considered them to be vexatious. The Commissioner has concluded that the Council is entitled to refuse to comply with requests 1, 2, 4, 10, 11, 12, 13, 14, 20 and 22 on the basis of section 14(1). However, the Commissioner has also concluded that the Council is not entitled to rely on section 14(1) to refuse to answer requests 7, 9, 15, 16, 17, 18 and 19. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: Provide a fresh response under FOIA to the requests numbered 7, 9, 15, 16, 17, 18 and 19 which the complainant submitted to the Council on 14 June 2013.
