The complainant has requested the council to confirm the councillors on the council in February 1993 and the councillors on the burial committee at that time. The council failed to issue a refusal notice within 20 working days of the receipt of this request so the Commissioner has found the council in breach of section 10 of the FOIA in this case. When the refusal notice was issued it stated that the requested information was not held. The Commissioner has reviewed this and made detailed enquiries to the council. He is satisfied that on the balance of probabilities the requested information is no longer held. The Commissioner does not require any further action to be taken in this case.
