The complainant has requested diverse mining data from the Coal Authority. The Coal Authority relied on regulations 12(4)(b), 12(4)(d), 12(5)(a), 12(5)(c) and 13 to withhold the requested information. The Commissioner’s decision is that the Coal Authority incorrectly relied on the aforesaid regulations, save to a limited extent its reliance on regulation 13 was correct. He therefore orders that the majority of the withheld information be released. The Commissioner requires the public authority to release to the complainant the information requested save for third party data which comprises the property address and property postcode as per the complainant’s “Request 1”. This decision notice is currently under appeal to the Tribunal.
