The complainant has requested detailed polling information collected in advance of the referendum on independence for Scotland in September 2014. The Cabinet Office refused to provide this information citing section 35(1)(a) as its basis for doing so (formulation/development of government policy). It upheld this position at internal review. The Commissioner’s decision is that the Cabinet Office is entitled to rely on section 35(1)(a) as a basis for withholding the requested information. No steps are required.
