The complainant requested information relating to the gender split of applicants applying for Non Molestation Orders (NMOs) and Occupancy Orders from 1st Jan 2011 to 30th June 2014. The Ministry of Justice (MoJ) provided exact figures where the numbers exceeded five but refused to provide figures less than five on the basis that individuals could be identified and section 40(2) was therefore engaged. The Commissioner’s decision is that MoJ has correctly applied section 40(2) to withhold figures less than five. He requires no steps to be taken.
