The complainant has requested any correspondence between senior BBC staff members and members of the Dame Janet Smith Review team (or Counsel/Secretariat to the Review) that relates to the scheduled publication date of the review findings. The BBC refused to provide the requested information under section 36(2)(b)(i) and (ii), section 36(2)(c) and section 40(2) FOIA. The Commissioner’s decision is that the BBC has correctly applied section 36(2)(b)(ii) and section 40(2) FOIA to the withheld information. The Commissioner requires no steps to be taken.
