The complainant has requested information from Isle of Wight NHS Trust (‘the Trust’) about ambulance response times. The Trust initially said that the information was exempt from disclosure under section 40(2) of the FOIA as it would need to manually examine patients’ health records to provide the information. During the Commissioner’s investigation, the Trust altered its position and now says that it is not obliged to comply with the request because it is vexatious under section 14(1). The Commissioner’s decision is that the request is vexatious and the Trust is correct not to comply with it. The Commissioner does not require the Trust to take any further steps.
