The complainant has requested information from the Education Authority (EANI) regarding a fatal road traffic accident which occurred in November 2014. The EANI disclosed some of the requested information to the complainant but refused to disclose the remainder, citing the exemptions under sections 36(2) and 40(2) as a basis for non-disclosure. The Commissioner’s decision is that the EANI has correctly applied the above exemptions to the information not disclosed to the complainant. Therefore the Commissioner requires no steps to be taken.
