The complainant requested information relating to a murder case. The Independent Police Complaints Commission (IPCC) disclosed some of the requested information, but withheld the remainder under the exemption provided by section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that section 40(2) was cited correctly in relation to some of the withheld content, but that the remainder of the withheld content was not exempt. The IPCC is now required to disclose the non-exempt content.
