The complainant requested information relating to the investigation into an allegation of legal aid fraud. The Ministry of Justice (MoJ) confirmed it held information within the scope of the request but refused to provide it citing sections 40(2) (personal information) and 31(1)(a) and (g) (law enforcement) of the FOIA. The Commissioner’s decision is that the MoJ correctly applied sections 40(2) and 31(1) of the FOIA. She requires no steps to be taken.
