The complainant has requested information from the Ministry of Defence (MOD) regarding a grievance he had brought against the MOD. The Commissioner has established that the MOD did not reply to the complainant’s request on the grounds that it is vexatious and subject to the MOD’s application of section 17(6) of the FOIA. The Commissioner’s decision is that the MOD is entitled to rely on section 17(6) of the FOIA and is therefore not obliged to reply to the complainant’s request. The Commissioner does not require the public authority to take any further steps.
