The complainant has requested copies of numbered draft versions of the published Childhood Obesity Strategy held by the Department of Health. The Department of Health refused the request on the basis of section 35(1)(a) of the FOIA. The Commissioner’s decision is that the Department of Health has correctly engaged the exemption but she considers the public interest in disclosure outweighs the public interest in maintaining the exemption. The Commissioner requires the public authority to disclose the drafts of the Childhood Obesity Strategy numbered 1, 35 and 68.
