Rossendale Borough Council

The complainant has requested information relating to an Empty Homes Revolving Fund Agreement.  Rossendale Borough Council refused the request under the exemption for commercial interests – section 43(2) of the FOIA.  The Commissioner’s decision is that Rossendale Borough Council failed to respond in time and breached section 10(1) and that it failed to demonstrate that section 43(2) is engaged.  The Commissioner requires the public authority to disclose the withheld information to the complainant.
