Animal and Plant Health Agency

The complainant has requested information relating to badger culling and bovine tuberculosis (bTB). The Animal and Plant Health Agency (APHA) refused to provide the information, citing regulation 12(4)(b) of the EIR (manifestly unreasonable request). The Commissioner’s decision is that the request was manifestly unreasonable and that the public interest lies in maintaining the exception and therefore the APHA was entitled to refuse it in accordance with regulation 12(4)(b). The Commissioner does not require the APHA to take any further steps.

EIR 12(4)(b): Complaint not upheld

Decision notice: ic-103904
