Department for Education

The complainant has requested any risk assessment related to the Department for Education’s (DfE’s) advice on face coverings in schools published in August 2020. The complainant also asked for the rationale behind the policy. The DfE refused the request on the basis of section 35(1)(a) of the FOIA. The Commissioner’s decision is that the DfE has correctly applied the section 35(1)(a) exemption and the public interest favours maintaining the exemption and withholding the information. Information Tribunal appeal EA/2021/0216 under appeal.
