Department for Environment Food and Rural Affairs

The complainant has requested the Department for Environment, Food and Rural Affairs (Defra) to disclose all the information it holds on the Walleys Quarry Landfill Site. Defra refused to disclose the requested information citing regulation 12(4)(b) of the EIR (manifestly unreasonable on the basis of cost). The Commissioner is satisfied that regulation 12(4)(b) applies to the request and that the public interest rests in maintaining this exception. He has also decided that Defra complied with its obligations under regulation 9 and provided appropriate advice and assistance to the complainant. The Commissioner does not require any further action to be taken.
