Home Office

The complainant has requested the equality impact assessment (EIA) relating to the relaxation conditions of Section 60 of the Criminal Justice and Public Order Act in the Best Use of Stop and Search Scheme (BUSSS). The Commissioner’s decision is that the Home Office was entitled to apply section 35(1)(a) of FOIA to withhold the requested information. The Home Office however breached section 17(1) of FOIA as it did not issue a refusal notice within the required timescales.
