Chief Constable of South Yorkshire Police

The complainant has requested various sets of information held by South Yorkshire Police (SYP) about an investigation into a serious offence which was committed in 2018. Whilst SYP provided information in response to part of the request, it refused the remaining elements, citing section 30(1)(a) – investigations and proceedings, and section 40(2) – personal data of third parties, of FOIA. The Commissioner’s decision is that SYP is entitled to rely on section 30(1)(a) of FOIA as its basis for refusing all parts of the request (with the exception of that part where it has already released the information).
