Summary
The opponents owned registrations for the mark TIME (and variations thereof) in Classes 9 and 16. The H/O concluded that the opponents had a reputation in their mark and that some goods were similar to some of those in the applicants application. The H/O decided, however, that the mark applied for could proceed if the specification was restricted to avoid the area of conflict with the opponents' marks.
