Summary
The opponents showed use of their unregistered mark since around January 1993. The Hearing Officer considered it reasonable to infer that the opponents were likely to have established a degree of goodwill and a reputation in the trade mark PROFESSIONAL SOLUTIONS. It followed that misrepresentation was almost unavoidable and damage would be caused to the opponents’ rights.
