Summary
This request for protection of an international registration was opposed by the proprietor of the mark SATINOX in Classes 11, 20 and 21. Having considered submissions by the applicants relating to the meaning of the suffix – INOX the Hearing Officer nevertheless came to the view that the word SATINOX should be regarded as an invented word and a very distinctive mark.
Certain of the goods in the specification were identical with or similar to those of the opponents. The Hearing Officer admitted that the overall assessment had not been easy but he found a likelihood of confusion in the case of those goods.
The opposition therefore succeeded in respect of them. The remainder of the application was permitted to proceed.
In view of the partial success of both sides the Hearing Officer made no award of costs.
