Summary
Ancon Limited initiated a reference under section 37 claiming entitlement in the patent in suit by virtue of section 39 on the grounds that the invention involved was made by Mr Szewczyk in the normal course of his duties while employed by them. Inventorship was not in issue. The Hearing Officer found on the facts that Ancon had made out their case on the balance of probabilities, and ordered that ownership of the patent should be transferred to them. Costs were awarded in Ancons favour.
