The evidence of use persuaded the Hearing Officer that there had been genuine use, but not across the full range of the specifications. He therefore reduced the specification to the apparatus and services upon which use had been precisely demonstrated. As both sides had achieved a measure of success the Hearing Officer ruled that each should bear it s own costs.
